Family Law in Westminster
Westminster is split down the middle by a county line. Two neighbors on opposite sides of the same street can have their divorces heard in courthouses twenty-five miles apart.
Westminster is Colorado's eighth largest city, about 116,000 people, and it sits in two counties at once. Roughly 71,000 residents are on the Adams County side and about 45,000 on the Jefferson County side. The city is one government, but almost everything layered underneath it splits along that line.
Two courthouses. Three school districts. Two separate park and recreation districts, Apex on the Jefferson side and Hyland Hills on the Adams side. For a family in a legal matter, knowing which side you are on is not trivia. It is the first question.

Which county is your address in?
If you live on the Adams County side, your case goes to the 17th Judicial District at the Adams County Justice Center, 1100 Judicial Center Drive in Brighton. If you live on the Jefferson County side, it goes to the 1st Judicial District at the Jefferson County Courts, 100 Jefferson County Parkway in Golden. The two are roughly twenty-five miles apart, with different judges and different local practice.
Colorado venue rules place a dissolution where either spouse resides, so a Westminster couple that separates across the county line may have a real choice between the two. That is worth deciding deliberately with counsel rather than defaulting to whichever address filed first.
The statewide requirements do not change either way: 91 days of Colorado domicile before filing under C.R.S. 14-10-106, a further 91 days after service before a decree, venue under C.R.C.P. 98(c), and a court approved parenting class routinely ordered for parents of minor children under C.R.S. 14-10-123.7.
The guideline math at Westminster's median income
A twenty year marriage reaches the long end of the guideline duration table. The illustrative facts: a 20 year marriage, a 70/30 earning split of Westminster's median household income of $100,272, two children, and 193 overnights a year with the lower earning parent.
Both figures come from the engines behind our free maintenance and child support calculators. They are illustrations, not predictions (how these examples are computed). For the full walkthrough of the 2026 child support law, read our attorneys' worked examples.
Dividing a Westminster estate
Westminster's housing stock spans older neighborhoods on the Adams side, newer construction toward the Jefferson side, and the ongoing redevelopment of the former mall site into a downtown district. For most families the home is the largest asset and the central question is whether one parent can carry it alone once the household splits.
Colorado divides marital property equitably under C.R.S. 14-10-113, weighing all the circumstances rather than splitting everything in half. Retirement accounts, vehicles, and any business interest come into the same analysis, and each divides by its own mechanics. Qualified plans in particular need properly drafted orders to divide at all.
Front Range Community College's Westminster campus serves more than 7,800 students, and re-entry education is a recurring thread in maintenance cases here. A spouse returning to school has both a present earning capacity and a future one, and the gap between them is exactly what the maintenance factors are designed to weigh.
Three districts, and one that works differently
Westminster addresses fall in one of three districts: Westminster Public Schools, historically Adams County School District 50, serving the older southeastern portion; Adams 12 Five Star; or Jeffco Public Schools on the Jefferson County side. Which one applies depends on the address, and a move across town during a separation can change it.
One of them deserves special attention in a parenting plan. Westminster Public Schools runs a fully competency-based system, where students advance by demonstrating mastery rather than by age-based grade level, and can move up at any point in the year. Standard parenting plan language about grade levels, promotion, and school-year transitions assumes a conventional calendar that this district does not follow. Plans covering children in that district should be drafted to match how the district actually works.
Questions we hear
Westminster family law FAQ
Which courthouse hears a Westminster divorce?
It depends on which county your address is in. The Adams County side files in Brighton, in the 17th Judicial District. The Jefferson County side files in Golden, in the 1st. The two courthouses are about twenty-five miles apart, so this is the first thing to confirm.
How do I find out which county I am in?
Your property tax notice and county assessor records will tell you, and each county’s parcel lookup confirms it by address. Roughly sixty percent of Westminster residents are on the Adams side and forty percent on the Jefferson side.
We separated and now live in different counties. Which one applies?
Possibly either, since Colorado venue is proper where either spouse resides. That makes it a decision rather than an accident, and the two districts differ enough in practice and scheduling that it is worth discussing before anything is filed.
Our children are in Westminster Public Schools. Does that change the parenting plan?
It should. That district uses a competency-based model where students advance by demonstrating mastery rather than by grade year, and can move up mid-year. Plan language written around conventional grade promotion and standard school-year transitions does not map cleanly onto it, so the provisions need to be drafted for how the district actually operates.
Does the county split affect anything besides the courthouse?
It reaches further than most people expect. School districts, park and recreation districts, and county services all split along the same line. None of it changes the legal standards, which are statewide, but it changes logistics, calendars, and which agencies you deal with.
